Terms of Service
The terms for using Bimo Cloud’s website and services, with responsibilities for business accounts, connected tools and WhatsApp integrations.
1. Operator, scope and agreement
These terms are issued by Bimo Cloud, Ndudi Street, Itega, Nkuhungu, Dodoma Region, Tanzania, postal code 41117. Contact support@bimocloud.com for service questions and info@bimo.tz for general or commercial enquiries.
These terms govern use of our website and the Bimo services made available to you. A paid subscription or custom deployment also has the price, duration, scope and other conditions presented and accepted for that order. Browsing the website or sending an enquiry does not purchase a subscription.
A signed customer agreement or order takes priority for its specific commercial scope. A data-processing agreement governs instructed processing of customer records. Nothing in a Bimo agreement overrides mandatory law or the terms imposed by Meta on WhatsApp Platform Data.
2. Authority and business accounts
Account holders must be adults with legal capacity to agree to these terms. If you act for a business or institution, you must have authority to bind it and to connect the accounts and records you use.
Provide accurate details, keep account access secure and notify us of suspected misuse. Do not share credentials with unauthorised people. The business is responsible for managing its authorised users and reviewing their permissions. Contact support if account access needs to be revoked or corrected.
3. Services and availability
Bimo Bizz supports business management through the features and limits in the applicable plan. Other Bimo solution pages may describe future directions. Only features actually provided or expressly included in your agreement form part of your service.
Enterprise deployments, custom integrations and merchant ecommerce require a separately agreed scope; they are not included merely because they appear on a solution page. Preview figures and scenes are illustrations, not customer testimonials, performance guarantees or promises of a specific result.
4. Plans, payments and cancellation
Your order or subscription identifies the fees, currency, billing period, applicable taxes, included allowances and any separately chargeable services. Published plan values are sourced from the current catalogue. Verify the terms presented for your purchase before paying.
Any recurring renewal, trial, change of plan or cancellation rule must be disclosed in the terms accepted for that subscription. Renewals, trials and refund conditions apply only as disclosed for the subscription and permitted by law.
Contact support@bimocloud.com for cancellation, billing errors or refund requests. We consider requests under the accepted order, applicable law and the circumstances of the payment. A refund or cancellation of Bimo fees does not automatically cancel a separate service or payment owed to Meta or another provider.
5. Customer data and responsibilities
You retain your rights in the records and materials you supply. You authorise Bimo to process them only as needed to deliver, secure and support the agreed service, follow your lawful instructions and comply with legal obligations.
You are responsible for the accuracy of your records, the legal basis for collecting and using them, appropriate privacy notices, required consents and the permissions of the people using your workspace. Do not upload information you have no right to use. Apply any additional requirements for children, staff records or sensitive information.
Bimo does not receive ownership of customer records merely by hosting them. Requests for export, correction or erasure must respect the rights of individuals, the authority of the requesting person and applicable legal record-retention requirements.
Read our Privacy Policy6. WhatsApp accounts and customer ownership
Where WhatsApp is enabled, an authorised administrator connects the customer’s own Meta business portfolio, WhatsApp Business Account and business phone number through the supported authorisation flow. You must have authority over those assets and comply with Meta’s verification and access requirements.
The customer is responsible for its payment method and charges billed by Meta through its own business account arrangements. Bimo service fees, if applicable, are separate and must be disclosed in the agreed order. Connecting Bimo does not transfer ownership of your business assets to Bimo or guarantee Meta’s approval of your account.
Bimo’s access is limited to the permissions granted for the agreed integration. You can revoke permissions through Meta’s applicable settings or request that Bimo disconnect the integration. Disconnection stops future authorised use; request data deletion separately if you also want existing information removed.
7. WhatsApp messaging rules
Use WhatsApp only for lawful communications permitted by the WhatsApp Business Messaging Policy and other applicable Meta terms. Obtain the recipient’s required opt-in before contacting them, keep appropriate evidence and respect requests to stop messaging, whether received on or off WhatsApp.
Use approved templates where Meta requires them, including outside the applicable customer-service window. Automated responses must provide a clear route to human assistance. Do not send spam, impersonate another business, conceal the sender or engage in restricted commerce or unlawful targeting.
Do not share one customer’s chat with another customer or ask for full payment-card, financial-account or identity-document numbers through an ordinary message. Health-related information and regulated goods are subject to additional restrictions. Your product category being supported by Bimo does not exempt it from WhatsApp’s restrictions.
Bimo may refuse, pause or disconnect a messaging connection where needed to address abuse, unauthorised access, a valid legal requirement or a provider restriction. Meta may separately limit messages, reject templates or restrict accounts. Bimo cannot guarantee message delivery, template approval or continued provider access.
8. Acceptable use
Do not use Bimo for illegal activity, fraud, harassment, harmful content, malware, unauthorised access, scraping that bypasses access restrictions, or disclosure of information you have no right to share. Do not try to access another business’s records or evade plan limits or security controls.
You must not sell, broker or use Meta Platform Data for a purpose prohibited by Meta. Do not use the service to build unrelated profiles or to supply a general-purpose AI training dataset without an expressly permitted, lawful basis. Unrelated AI training is not an authorised purpose of Bimo’s WhatsApp connection.
9. Third-party services and AI
Meta, payment processors, messaging providers and other connected services operate under their own terms. You are responsible for complying with the conditions of the services you connect. Bimo’s own responsibilities for information it handles are described in the Privacy Policy and any applicable data-processing agreement.
An optional AI or automated feature must be identified before it is used. Review its scope, data handling and limitations. Outputs can be incomplete or incorrect and require human review; do not rely on them as the sole basis for financial, legal, medical, employment or other consequential decisions.
10. Intellectual property
Bimo software, brand assets and original website materials remain the property of their respective owners. Your service agreement gives you permission to use the service for its agreed purpose, not ownership of its software or branding.
Third-party materials remain subject to their licences. You may share links to the website. Reproduction of protected materials or use of Bimo branding requires permission unless applicable law allows it.
11. Support, maintenance and changes
Contact support@bimocloud.com for help. Support scope, maintenance arrangements and any service-level commitment are defined by the applicable subscription or customer agreement. These terms do not create a guaranteed response time or uptime percentage.
We may maintain or change the service, including to meet legal or provider requirements. Where a change materially affects an agreed paid service, we provide appropriate notice and follow the accepted agreement and applicable law.
12. Suspension, termination and records
Access may be limited where needed to protect people or the service, address a material breach, comply with law or enforce agreed payment conditions. Where practicable, we explain the reason and a way to address it; an urgent security or legal issue may require immediate action.
Contact support to end a service or request an export or deletion. Ending access, disconnecting a provider and deleting records are separate processes. We handle customer and individual requests under the Privacy Policy, the customer’s lawful instructions and applicable law.
Meta Platform Data must not be kept simply because a normal subscription offboarding period has not ended. Meta’s required deletion rules and a valid legal retention requirement take priority. Any retained information must have a documented lawful purpose and appropriate restrictions.
Data-deletion instructions13. Care, limitations and legal rights
We aim to provide the agreed service with reasonable care. Online services can experience faults, delays or interruptions. A software feature does not replace your responsibility to check records, supervise staff and obtain qualified advice when needed.
Responsibility for a loss is determined by the accepted customer agreement and applicable law. The remedies in an existing customer agreement remain subject to applicable law. Nothing excludes liability or a consumer or data-protection right that cannot lawfully be excluded.
14. Governing law and disputes
These terms are governed by the laws of the United Republic of Tanzania, except where mandatory law requires otherwise. Contact support@bimocloud.com with a concern so we can seek a practical resolution.
If a dispute cannot be resolved, it may be referred to a court or authority with lawful jurisdiction. These terms do not require compulsory private arbitration or prevent you from contacting a regulator or exercising a right available under applicable law.
15. Changes and contact
These terms are effective from 7 October 2026. We publish updates with a revised date and provide appropriate notice of material changes. A website update does not retroactively alter the price or specific scope of an existing accepted order.
If part of these terms is unenforceable, the remaining parts continue to the extent the law permits. Failure to enforce a term immediately does not waive it. For a question about these terms, email support@bimocloud.com or write to Bimo Cloud at the address in section 1.
